Insurance appraisal in Idaho

Idaho requires fire insurance to use the New York standard fire policy as revised in 1943, so the appraisal clause in that form is part of Idaho law. The standard wording gives 20 days to name appraisers and 15 days to settle on an umpire. The Idaho Supreme Court has enforced an umpire's determination against a policyholder who tried to undo it.

Either side starts appraisal with a written demand. In the standard wording each side then has 20 days to name a competent appraiser, and the appraisers have 15 days to agree on an umpire before either side can ask a judge to choose one.

Idaho law has a payment marker that matters after an award. Idaho Code 41-1839 gives an insurer 30 days after proof of loss to pay what is owed under the policy. If it does not and the policyholder later sues or arbitrates, a court may award reasonable attorney's fees, unless the insurer tendered the full amount owed first.

What the panel decides

Amount of loss

Appraisal fixes the amount of loss. Coverage is a separate question. Many forms say so directly. A common State Farm association form, for example, says that even with an appraisal the carrier keeps its right to deny the claim.

In Villa Highlands, LLC v. Western Community Insurance Co., 148 Idaho 598 (2010), a builder's risk dispute, the policyholder stipulated to a loss figure, the court later sent the dispute through the policy's appraisal process on actual cash value, and the umpire found the insurer's appraisal more reliable. We found no Idaho appellate decision that says whether appraisers may decide what caused damage, so that point is open here.

Who may serve

We found no Idaho license for property claim appraisers. Policy wording asks for a competent and impartial person, and the standard fire form says competent and disinterested. A contractor who will do the repairs, a public adjuster paid a share of the claim, or anyone employed by a party does not fit that description. Public adjusters are a separate role: the Idaho Department of Insurance says a public adjuster who represents you must be licensed and bonded.

The award

In Villa Highlands the Idaho Supreme Court affirmed the denial of a motion to set aside the umpire's determination and held that the umpire's decision was binding on the policyholder. The policyholder had stipulated to the loss amount and did not submit its own appraisal until just before trial. We did not find an Idaho statute that lists the grounds for setting aside a property appraisal award, so this guide does not list any.

Points particular to Idaho

  1. Idaho Code 41-2401 requires fire policies to use the form known as the New York standard as revised in 1943. A policy that combines fire with other perils may depart from the form if its fire coverage is at least as broad, the mortgagee provisions are unchanged, the policy is complete on its own and the Director of Insurance approves. In 2026 the legislature amended this section; the change, effective January 1, 2027, lengthens cancellation and nonrenewal notice to 60 days and does not touch appraisal.

  2. Idaho Code 29-110(1) declares void any contract term that limits the time within which a party may enforce rights, except arbitration clauses that do not require arbitration outside Idaho. We could not confirm how Idaho courts apply that rule to the suit clause in a property policy, so do not assume it extends your deadline.

  3. Idaho Code 41-1839 allows attorney's fees against an insurer that fails to pay the amount justly owed within 30 days after proof of loss, if the claimant then sues or arbitrates. It is the exclusive basis for statutory fees in these disputes, and no fees are allowed if the insurer tendered the full amount owed before the action.

Questions

Does my Idaho homeowners policy have an appraisal clause?

Almost certainly. Idaho Code 41-2401 requires fire insurance to follow the 1943 New York standard form, which includes appraisal, and homeowners forms carry their own appraisal paragraph. Look in the conditions section under the heading Appraisal.

How long do we have to name an appraiser in Idaho?

In the standard-form wording, 20 days from the written demand. Many homeowners forms use the same number. Your policy controls, so read the paragraph and answer in writing as early as you can.

Who chooses the umpire in Idaho if the appraisers cannot agree?

A judge of a court of record, when either side asks, under the standard wording. The appraisers get 15 days to agree on their own first. Some forms say a court with jurisdiction instead.

Can the appraisers decide whether my loss is covered in Idaho?

No. Appraisal sets the amount of loss, and many forms state that the carrier keeps its right to deny the claim. We found no Idaho appeals decision on whether appraisers may decide what caused the damage.

Does demanding appraisal pause the deadline to sue in Idaho?

We found no Idaho rule that says it does. Treat the suit deadline in your policy as running and note the date before you demand appraisal.

Do appraisers need a license in Idaho?

We found no state license for property claim appraisers. The policy asks for a competent and impartial person. Public adjusters are different: they must be licensed and bonded in Idaho.
